Terms and Conditions (Nigeria)
These Terms and Conditions (“Terms”) govern your access to and use of the Elberith platform, website, applications, and services (collectively, the “Platform”) operated by Elberith Group (“Elberith”, “we”, “us”, “our”), a company established in the Nigeria.
By accessing or using the Platform, you agree to be legally bound by these Terms.
1. Definitions
- “User”: Any person booking or using services through the Platform.
- “Operator / Partner”: Transport, chauffeur, courier, or freight service providers fulfilling bookings.
- “Affiliate”: A person or entity promoting Elberith services for a commission.
- “Services”: Ride/Taxi, Chauffeur, Courier, and Freight services.
- “Booking”: A confirmed service request made via the Platform.
2. About Elberith
Elberith is a technology platform that connects Users with independent Operators and Partners. Elberith is not a transport carrier, courier company, freight handler, airline, or travel agent. Services are delivered by independent Operators.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.
4. User Accounts
You are responsible for:
- Providing accurate information
- Maintaining account confidentiality
- All activity under your account
We may suspend or terminate accounts for misuse or breach of these Terms.
5. Nature of the Platform
Elberith acts as an intermediary technology provider. The service contract for any Booking is between the User and the relevant Operator.
Elberith is not liable for the operational execution of services.
6. Bookings and Payments
- All Bookings must be made through the Platform.
- Prices are displayed before confirmation.
- Payment must be made in advance unless agreed otherwise.
- A Booking is confirmed only after payment is successfully processed.
7. Cancellations and Refunds
Cancellations and refunds are governed by the Refund & Cancellation Policy published on the Platform, which forms part of these Terms.
8. Operator Responsibility
Operators are solely responsible for:
- Licenses, insurance, and legal compliance
- Service quality and punctuality
- Safety of passengers, goods, and deliveries
Elberith does not control vehicles, drivers, routes, or the handling of goods.
9. Prohibited Use
You agree not to:
- Misuse the Platform
- Attempt fraud or payment abuse
- Harass Operators or staff
- Reverse engineer or disrupt the Platform
10. Intellectual Property
All content, branding, software, and materials on the Platform are owned by Elberith. You may not copy, distribute,or reuse them without permission.
11. Limitation of Liability
To the maximum extent permitted by law, Elberith shall not be liable for:
- Delays, cancellations, or service failures by Operators
- Loss of or damage to goods. during courier/freight services
- Indirect or consequential losses
Our total liability shall not exceed the amount paid for the Booking.
12. Indemnity
You agree to indemnify Elberith against any claims arising from:
- Your misuse of the Platform
- Your breach of these Terms
- Disputes with Operators
13. Suspension and Termination
We may suspend or terminate access without notice if you breach these Terms or misuse the Platform.
14. Privacy
Your data is handled according to our Privacy Policy.
15. Changes to Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Nigeria.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria.
17. Force Majeure
Elberith is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, war, pandemics, or government restrictions.
18. Severability
If any provision is found invalid, the remaining provisions remain in effect.
19. Entire Agreement
These Terms, together with referenced policies, constitute the entire agreement between you and Elberith.
20. Payment Methods
Elberith currently supports card payments processed through Stripe and cash payments collected by the driver, where those methods are available for the selected service. A booking may require payment or payment confirmation in accordance with the instructions shown in the app. Adyen and dLocal are not currently available as customer payment methods.
21. Fares, Taxes and Additional Charges
The amount payable for a booking may include the accepted or final fare, applicable taxes and additional charges such as tolls and parking. Tolls and parking charges are allocated in full to the driver under Elberith’s current settlement rules and are excluded from the commission split applied to the base fare. The fare and any applicable charges shown for a booking should be reviewed before confirming the booking.
22. Cancellations and Refunds
Cancellation eligibility and any applicable cancellation charges depend on the service and the time at which the booking is cancelled. The detailed rules are set out in Elberith’s Refund and Cancellation Policy. Where a refund is due, the amount and method of refund depend on the booking, payment method and applicable policy. Cash cancellation charges, where applicable, may be recorded against the customer’s account and added to a subsequent ride fare.
23. Drivers, Operators and Settlements
Driver and operator earnings are calculated under the applicable commission and settlement rules for the service, vehicle type, driver’s country and operator arrangement. For eligible online payments, driver and operator shares are credited to their respective platform balances, while the platform fee and applicable tax are accounted for by Elberith. Cash rides are collected physically by the driver and may be subject to separate settlement and collection arrangements under the applicable driver or operator agreement.
24. Payouts
Payouts are subject to account verification, an active connected payout account, payout eligibility and available balance. The current configured minimum payout amount is £50 for drivers and £100 for operators. Payouts may be subject to administrative approval or automated processing. The time taken for funds to reach a bank account may depend on the payment provider and the receiving bank.
25. Support and Payment Issues
If you have a question about a payment, cancellation, refund or ride, contact Elberith through the support options provided on the website or in the app. Please include the relevant booking details, but do not send full payment-card details through support messages.
Before publication: verify the payout amounts and current production schedule, ensure all terms are consistent with the relevant country law, and have the cash collection and settlement clauses reviewed in driver/operator agreements.
