Fraud Disclaimer

1. Purpose

Elberith is committed to maintaining a secure, transparent and trustworthy platform for customers, drivers, transport operators, corporate clients, affiliates and other authorised users.

This Fraud Disclaimer explains prohibited fraudulent activities, the measures Elberith may take to protect the platform, and the responsibilities of users when accessing or using Elberith services.

2. Prohibition of Fraudulent Activities

Users must not use the Elberith website, applications, payment systems or services for fraudulent, deceptive, unlawful or dishonest purposes.

Prohibited activities include, but are not limited to:

Providing false, misleading, forged or altered personal, business, identity, driving licence, vehicle registration, insurance or operator documents.
Creating accounts using false identities, stolen information or another person’s details without lawful authority.
Using stolen payment cards, unauthorised payment accounts or fraudulent payment methods.
Making false refund requests, chargeback claims, cancellation claims or no-show reports.
Creating fictitious bookings, manipulating fares or deliberately misrepresenting completed or cancelled journeys.
Manipulating promotional offers, referral programmes, affiliate commissions, incentives or platform rewards.
Impersonating Elberith employees, representatives, drivers, operators, customers or other users.
Attempting to obtain another user’s passwords, verification codes, payment credentials or account access.
Circumventing platform security, identity verification, payment controls or fraud-prevention systems.
Colluding with other users to manipulate transactions, bookings, ratings, reviews, commissions or payouts.
Using the platform to facilitate money laundering, financial crime, identity theft or other unlawful activities.

3. User Responsibilities

All users are responsible for providing accurate information, protecting their account credentials and using Elberith services honestly.

Drivers and operators must ensure that their submitted documents are genuine, their licences and insurance are valid, and their booking, journey, cancellation and payment records are accurate.

Customers must use valid payment methods, provide truthful booking information and refrain from making fraudulent payment disputes or refund claims.

Affiliates and business partners must report genuine referrals and commissions accurately and must not manipulate tracking systems or misrepresent Elberith services.

4. Fraud Detection and Investigation

Elberith may review booking records, payment activity, account information, submitted documents and other relevant transaction information where reasonably necessary to detect, prevent or investigate suspected fraud, subject to applicable data-protection laws.

Where suspicious activity is identified, Elberith may request additional information or supporting documentation and may temporarily restrict a transaction or account while conducting a reasonable investigation.

Any monitoring or investigation will be carried out in accordance with applicable law and Elberith’s Privacy Policy.

5. Suspension and Account Termination

Where Elberith reasonably suspects fraudulent activity or identifies a violation of its applicable terms, it may take proportionate protective action, including:

Rejecting a fraudulent or incomplete application.
Temporarily restricting account access or booking functionality.
Suspending a driver, operator, customer, affiliate or partner account.
Withholding disputed payouts or transactions where legally permitted and subject to applicable payment and contractual requirements.
Cancelling fraudulent bookings.
Recovering amounts lawfully owed to Elberith.
Terminating an account or business relationship in accordance with applicable terms and law.
Reporting suspected criminal activity to the appropriate authorities where legally required or permitted.

Elberith will not treat an unsubstantiated allegation alone as conclusive proof of fraud. Actions will be assessed in light of the available evidence, applicable contractual terms and legal requirements.

6. Reporting Suspected Fraud

Users who suspect fraud, impersonation, unauthorised account access, suspicious payment activity or document falsification should report the matter through Elberith’s official support channels.

Please provide the relevant booking reference, transaction reference, account information and a description of the suspected activity, together with supporting evidence where available.

Do not send passwords, one-time verification codes or complete payment card credentials when reporting an incident.

7. Limitation and Legal Rights

Elberith takes reasonable steps to prevent and respond to fraudulent activity but cannot guarantee that every fraudulent attempt will be detected or prevented.

Nothing in this Disclaimer excludes or limits any liability, consumer right or legal obligation that cannot lawfully be excluded or limited under applicable law.

Elberith may cooperate with competent authorities in relation to suspected fraud, subject to applicable legal requirements.

8. International Application

This Disclaimer applies to Elberith services in the countries and regions where those services are offered, including the United Kingdom, United States, France, Germany, Spain, South Africa, the United Arab Emirates, China, Nigeria and Ghana.

Where local law imposes additional or different requirements, the applicable mandatory legal requirements will prevail.
