Welcome to Elberith Global (the “Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our websites, mobile apps and other online services (collectively, the “Platform”) and your use of the services (the “Services”) made available through the Platform.
By accessing or using the Platform or Services, you affirm that you are at least the age of legal majority in your jurisdiction and agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Platform or Services.
In these Terms, the following definitions apply:
“User”, “you” or “your” means any person accessing the Platform or using the Services
“Supplier” means any individual or entity that provides services (e.g., ride-hailing, taxi, courier, freight or flight-booking services) through the Platform
“Booking” means a request placed by you through the Platform for a Service from a Supplier via the Platform.
“Partner” means a corporate entity or individual that enters into an agreement with the Company to provide Services or to be part of our network
“Third Party Provider” means any independent service provider (Supplier) with whom a Booking is ultimately fulfilled.
3.1 The Company acts as a facilitator through the Platform, connecting Users, Suppliers and Partners. Your contract for services is with the Supplier who fulfills your Booking (or with you, if you are a Supplier). The Company is not the Supplier and does not itself provide the underlying services unless expressly
stated.
3.2 These Terms, in conjunction with any Service-specific terms and the Privacy Policy, form the entire agreement between you and the Company, superseding any prior agreements.
4.1 To access certain features, you must register for an account (“Account”). You agree to provide accurate, current and complete information during registration and to update such information to keep it accurate.
4.2 You must keep your login credentials confidential and be responsible for all activities under your Account. Notify us immediately of any unauthorized
use.
4.3 You represent and warrant that you are at least 18 years old (or the age of legal majority in your jurisdiction).
4.4 You agree to use the Platform only for lawful purposes and in compliance with all applicable local laws and regulations. You shall not use the Platform to transport illicit, hazardous or prohibited goods except as permitted by law and by the Supplier’s contract.
5.1 When you place a Booking through the Platform, the Supplier’s terms and conditions and pricing apply. You are responsible for paying all charges for the Services as defined in the Booking.
5.2 Payment may be processed via the Platform on behalf of the Supplier. The Company may act as payment collection agent but is not the ultimate provider of the Service.
5.3 All prices are shown in the currency specified and may include taxes, fees or surcharges where applicable.
5.4 Cancellations, amendments and refunds shall be governed by the Supplier’s policy and the terms presented at booking. The Company does not guarantee that refunds or amendments are available.
5.5 Promotional codes, discounts or offers (“Promo Codes”) are subject to the specific terms applied to that offer and may be revoked or changed at any time at our discretion.
6.1 We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform in accordance with these Terms.
6.2 You agree not to:
copy, reproduce, modify, distribute or create derivative works of the Platform;
reverse engineer, decompile or attempt to derive source code of the Platform;
scrape, harvest or collect data from the Platform without our explicit permission;
use the Platform in a way that disrupts its operation or degrades performance.
6.3 You must comply with all applicable laws, rules and regulations when using the Platform.
7.1 If you are a Supplier or Partner, you warrant that you hold all required licenses, permits, insurance and meet all regulatory requirements for providing the Services in each jurisdiction.
7.2 Suppliers may only use the Platform to offer Services in authorized regions and must comply with our quality, safety and conduct standards.
7.3 The Company does not guarantee any minimum volume of Bookings for Suppliers and shall not be liable for Supplier performance. Users acknowledge that Suppliers operate independently.
All intellectual property rights in the Platform, including design, text, graphics, logos, software and trade-marks, are owned by or licensed to the Company. Except as expressly permitted in these Terms, you may not use our trade-marks, logos or content without our prior written consent.
9.1 The Platform and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. Your use of the Platform and Services is at your own risk.
9.2 The Company makes no guarantee regarding the availability, timeliness, quality, fitness for a particular purpose, legality or accuracy of any service provided by a Supplier.
9.3 Under no circumstances shall the Company, its affiliates or their officers, directors or employees be liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, lost data, personal injury or property damage arising from or in connection with your use of the Platform or Services, even if we have been advised of such possibility.
9.4 The Company’s total aggregate liability to you in connection with these Terms shall not exceed the total amount paid by you for the relevant Booking in the preceding twelve (12) months.
9.5 Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law.
We may amend these Terms at any time. If we do so, we will post the updated Terms on the Platform and update the “Last Updated” date. Your continued access or use of the Platform after the effective date of changes constitutes acceptance of such amendments.
11.1 We may suspend or terminate your access to the Platform at any time for violation of these Terms or at our sole discretion.
11.2 Upon termination, you must cease all use of the Platform and refrain from accessing your account. Termination does not limit our right to pursue other remedies.
12.1 These Terms shall be governed by and construed in accordance with the laws of [Insert applicable jurisdiction/country].
12.2 Any dispute arising out of or in connection with these Terms, the Platform or Services shall be resolved by [insert method: e.g., arbitration or courts of a specified jurisdiction].

14.1 Entire Agreement: These Terms, the Service-specific terms and the Privacy Policy constitute the entire agreement between you and the Company regarding the Platform and Services.
14.2 Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
14.3 Waiver: Failure by us to enforce any right or provision of these Terms does not constitute a waiver of that right.
14.4 Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.5 Notices: We may deliver notices to you via email, push notification, or posting on the Platform.
14.6 Electronic Signature: By accessing the Platform and using the Services you agree that such access constitutes your electronic signature.
